Summary
The Board of Zoning Appeals approved a variance July 20, 2025, allowing Michael Bolgree to construct a detached accessory garage that does not meet the 80-foot setback from the center of the road; the board made the routine findings and voted to approve.
The Jefferson County Board of Zoning Appeals voted July 20, 2025, to grant a variance to Michael Bolgree of 12385 West Enron Road in Deputy, Indiana, allowing him to place a detached accessory garage closer to the road than the board’s stated 80-foot setback requirement.
Bolgree told the board he has available space that does not meet the 80-foot setback from the road; he said the proposed garage location would sit about 55 feet from the road and about 5 feet from the side property line. “I do have an available space, but it does not meet the 80 foot from center to start the building. It would be, I believe, ... 55 feet from the road,” Bolgree said. He also said he had notified neighbors and mailed required notices.
Board members read the standard findings required for a variance and concluded the approval would not be injurious to the public health, safety, morals or general welfare, would not substantially affect adjacent property values, and that strict application of the ordinance would result in practical difficulties. A motion to approve the variance was made and seconded; the board approved the motion on a voice vote. The motion record shows the second as Eric. The board instructed Bolgree to meet with county staff (Josh) to complete final paperwork; staff said the approved paperwork would be emailed to Bolgree the next day.
During discussion, board members and staff confirmed the proposed garage would be detached and described by the applicant as "by 30" in his presentation, would not contain plumbing and would avoid existing easements. The applicant said the neighboring house across the driveway was vacant and that the garage location would avoid removing trees and would provide privacy if the neighbor returns to occupancy.
Bolgree left with the board’s approval and was told to follow up with staff for final documentation.
