The Paulding County Planning Commission voted to deny a request to amend a 2006 PRD stipulation that would reduce the front setback for homes from 25 feet to 15 feet on a 50.336‑acre parcel owned by Weekly Homes LLC.
Land‑use attorney Kevin Moore, speaking on behalf of the applicant, said the developer plans an age‑restricted community and that reducing the front setback would allow a deeper single‑floor home plan desirable for older buyers. Moore said the community will use private streets, will record covenants and that driveways will meet the project's parking and length requirements.
Commissioners questioned whether reopening a 2006 PRD to change setbacks would set a precedent for revisiting other previously approved PRDs. Commissioner Mitch Leggett moved to deny the amendment, seconded by Commissioner Fitzgerald. The motion passed with a recorded tally of five in favor, one opposed and one abstention. The commission’s recommendation now goes to the Board of Commissioners; staff advised the applicant to meet with Planning staff about next steps.
Moore requested the Planning Commission forward a favorable recommendation consistent with staff's analysis; commissioners instead emphasized long‑term uniformity with previously approved PRDs. A public comment period on the item produced no speakers in opposition.
The denial only affects the requested stipulation amendment; no other stipulations or approvals were changed in this action. The applicant may pursue the item with the Board of Commissioners at its next meeting or revise the proposal and return to staff for guidance.
