The Independence Planning Commission on Jan. 23 voted to extend the city’s land-use approval for Brandy Meadows — SUP 2022-02, phases 5 through 9 — for an additional year.
Planning staff reported that the applicant submitted an extension request on Dec. 23, 2024, and that the request met the four extension criteria the commission reviews for such requests: it was filed at least 45 days before the approval expired; the project remains in substantial conformance with the originally approved plan; the applicant provided reasons for the delay; and no relevant code provisions have changed. "They did submit it on Dec. 23, 2024," staff member Brandon said, adding the applicant cited higher interest rates and increased system development charges as reasons for the delay.
The commission used the sample motion presented by staff and voted in favor of extending the land-use approval with the conditions and findings articulated in the project notice of decision. Commissioners present at roll call and participating in the vote were Commissioner Source, Commissioner Alvarez, Commissioner Jay and Commissioner Proscovac; Commissioner Carpenter was excused. The motion passed on a voice vote; commissioners answered "Aye." The commission did not record a roll-call tally for each member during the vote.
Why it matters: The extension preserves the developer’s right to proceed under the previously approved plan while they address financing and other market constraints. Brandy Meadows is a multi-phase residential project previously approved as part of SUP 2022-02 that included roughly 186 dwellings in the overall application.
What the commission said: Staff advised that the extension would allow the applicant to proceed through the existing approval path rather than restarting review. Staff also noted that the application did not propose changes to the approved plan.
Next steps: The extension adds one year to the approval period under SUP 2022-02; staff and the applicant will continue permitting and project planning under the existing approval and its conditions.
