Weld County approves ordinance prohibiting graywater systems

Weld County commissioners on March 26 approved on second reading Code Ordinance 2025-02, repealing and reenacting Chapter 2 (Administration) of the Weld County Code to prohibit graywater systems.
The measure, which staff brought after a February work session, implements a local prohibition while recognizing state law that gives jurisdictions the option to opt out, Planning Director David Isenbrand said. The board held the ordinance’s required second reading, took no public comment and then voted to adopt it.
Isenbrand, director of Planning Services, told commissioners the proposal followed House Bill 241362 and county review at a February work session. He said no amendments were proposed at the March 10 first reading and staff recommended approval at second reading. “As a reminder, we did have a work session in February regarding House Bill 241362, which provided some guidelines, as long as they follow the state regulations,” Isenbrand said.
Commissioner Jason Maxey moved to approve the ordinance on second reading; Commissioner Kevin Ross seconded. The board took the voice vote and the motion passed with all commissioners answering in the affirmative.
No members of the public spoke during the public comment period on the ordinance.
The ordinance is recorded as Code Ordinance 2025-02 in county records; the first reading occurred March 10, 2025, and staff recommended adoption at the second reading on March 26, 2025.
