Council indefinitely postpones second-reading amendment to MDD board rules after public concern

The Fair Oaks Ranch City Council voted to postpone indefinitely the second reading of an ordinance that would amend the municipal development district (MDD) board provisions in the city code. The action followed public comment and discussion by council members who said the MDD should be given an opportunity to review the proposed changes.
Resident Jim Roth spoke during Citizens to Be Heard raising procedural concerns about a prior meeting in which three city council members also served as MDD members and two MDD members were asked to leave the meeting. "They were denied their first amendment right to address the council on an agenda item," Roth said, and asked council to void the prior 6-1 first-reading vote and apologize to two MDD members. Roth also asked the council to clarify who controls the MDD and whether the MDDs bylaws (referred to in the record as rules of procedure) limit the board's authority.
Councilmember Keith, who also sits on the MDD, motioned to postpone the second reading indefinitely so the MDD could review the amendment language at its upcoming meeting. He said the MDD had begun conversations but had not taken formal action and that giving the MDD time to recommend changes would prevent piecemeal adjustments by council. "I feel like it might just be in the best interest of both the council and the MDD just to put it on pause," Keith said. Other council members agreed that the MDD operates under rules of procedure and that the group should be allowed to continue the discussion.
The motion to postpone indefinitely was seconded and passed on a voice vote. Council made clear that MDD meetings and rules of procedure remain public and that the city council appoints MDD members but does not routinely direct day-to-day MDD decisions under state law. Staff and council agreed the MDD will have an opportunity at its next meeting to review and, if desired, recommend modifications for council consideration.
