Commission debates adding tree-maintenance plat note to all plats; agrees to revisit policy

The commission discussed whether a plat note requiring compliance with Appendix F2 of Section 24-83 of the Laredo Land Development Code (tree planting and maintenance procedures) should be recorded on the face of every plat moving forward.
Ben Puig, representing Farias Development, told the commission he disagreed with adding the plat note as a permanent recorded encumbrance at this time and asked that the commission study the matter further. "We disagree with plat comment number 4 and allow the commission to study this issue further to determine whether or not this is the uniformity we want on all plats moving forward before we go to final," Puig said.
Planning staff said they had seen multiple plats submitted with that plat note and recommended including a plat note to make the obligation explicit to future owners; staff described Appendix F2 as roughly 1.5 pages of tree-planting and post-plant maintenance guidance. Commissioners and applicants agreed that, if the city intends to apply this consistently, it should be formalized and noticed to the public. Several commissioners said the right course was to consider a formal policy or commission-level action so the public and applicants have notice and input.
As a practical result, the commission allowed applicants to request removal of the specific plat note on individual preliminary plats in several motions at the meeting and directed staff to add an item to a future agenda to discuss the broader policy. One commissioner said putting the note on a recorded plat makes it permanent and that the commission should be deliberate before creating a new recurring encumbrance.
