Plan Commission approves Southern Meadows phasing amendment, adds updated written commitments

The Monroe County Plan Commission voted to approve a preliminary-plat amendment for the Southern Meadows major subdivision that reconfigures phases 4–6 and updates the developer—s written commitment setting timelines for off-site improvements.

The action, taken at the Plan Commission—s March meeting, passed on a roll call vote of 7–0. The amendment keeps the previously planned road connection to South College Drive in phase 4, retains an additional turn lane on South Old State Road 37 in phase 4, and assigns the asphalt side path to Clear Creek Elementary to phase 6.

Why it matters: the amendment changes how the remaining 37+ acres are phased, shifting some lots into noncontiguous segments within phases and adding a new, staff-reviewed schedule for completing critical safety and access improvements.

Planning staff told the commission the petitioner proposes to split phase 4 and phase 6 into two noncontiguous sections but build each as if contiguous. "The written commitment amendment updates the timeline for completion of these off-site improvements and establishes commitments to the timing of their completion," said Drew Myers, planning staff, summarizing the updated language in exhibit 8.

The petition includes a schedule requiring: (1) the roadway from South Abingdon Avenue to South College Drive to be installed prior to recording the final plat for phase 4 (final surface coat, sidewalks and street trees excepted); (2) the turn lane on South Old State Road 37 to be installed prior to recording phase 4; (3) the turn lane on South Rogers Street to be installed prior to recording phase 5; and (4) the asphalt side path to Clear Creek Elementary to be completed with phase 6. Staff—s recommendation also included coordination with the adjacent Blind Squirrels LLC (the CINL project) regarding the multi-use path along South Rogers Street.

Commissioners asked about floodplain permitting at the main entrance and the need to reapply to the Indiana Department of Natural Resources for a permit that had expired. "They had originally received a permit through DNR to do work in the floodplain, and that permit had expired," Myers said; the commission and staff stressed the importance of the South College Drive connection as alternate access in light of floodplain conditions at the West Thad Road/South Rogers Street intersection.

Petitioner representative Todd Borgman said staff and the developer had worked to a compromise and that the developer agreed with staff—s recommended language. Members of the adjacent CINL project urged the commission to approve the amendment so that the developer—s commitments to construct the roadway improvements will move forward.

The motion approving the preliminary plat amendment was made and seconded on the record; the roll-call vote recorded seven yes votes and zero no votes, with one commissioner recorded as "present" for part of the meeting earlier. The approval is subject to the conditions listed in the staff report, including recording the amended written commitment within 14 days of approval.

The commission—s action is a final Plan Commission recommendation; the amended written commitment and the preliminary-plat files become part of the subdivision record and will be used to monitor implementation of the required off-site improvements.
