Committee adopts amendment and reports amended Senate Bill 101 to Rules and Reference

The Senate Local Government Committee on the floor adopted Amendment 0245‑1 to Senate Bill 101 and voted to report the amended bill favorably to the Committee on Rules and Reference.

Vice Chair Gavarone moved to adopt amendment 0245‑1. The amendment “specifies that a trustee is not required to rerecord a memorandum of trust or some other instrument that contains the same information at the time real property held by the trust is conveyed, if the memorandum or instrument is already of record,” and clarifies that recording is required when real property held by the trust is conveyed by or to the trustee of a disclosed trust. The committee chair noted the amendment was requested by the bill sponsor and came from the State Bar Association as a clarification of intent. Seeing no objection, the committee adopted the amendment.
