Assembly approves Cape Cod Commission development‑agreement regulation update after tense debate

The Barnstable County Assembly of Delegates voted on July 2 to adopt proposed ordinance 2025‑10, which updates the Cape Cod Commission's development‑agreement regulations. The measure was the subject of a multi‑hour discussion in which delegates raised procedural and substantive questions about notice, local review responsibilities and public input.

Counsel for the Cape Cod Commission told the Assembly that under the Cape Cod Commission Act the Assembly must either adopt the ordinance or return it for restudy and redrafting; counsel said a simple postponement would not satisfy the statute. That clarification shaped the floor debate and the procedural options available.

Several delegates asked for additional time, requested redlines, or said town planners had not been adequately informed; other delegates and town planners reported they had reviewed the regulation and supported it. Director Senatori for the Cape Cod Commission said staff had "gone through these regulations with a fine tooth comb," and noted some inaccuracies in an emailed commentary provided to delegates earlier in the day.
