The special magistrate on Monday heard a status update on after‑the‑fact permits for a proposed restaurant operation known as Grilling & Chilling and was told building and planning reviewers issued multiple denials.
Joanne Bolin, the city’s permit administrator, told the magistrate that the last review cycle completed June 10 and that planning and zoning had issued a third denial. Building plan review also recorded a denial dated June 13, although the fire division had approved the submission.
Bolin summarized outstanding deficiencies: building plans were illegible and needed to be redrawn so text and elements are clear; pergola plans required signed, sealed engineering showing wind loads and anchor details; plans needed to show required restrooms and plumbing accessibility compliant with the Florida Building Code and ADA requirements; and planning required a current survey showing the proposed fence location at the maximum height allowed and confirmation that pergola and other features meet required setbacks under LDC section 6.24 and the city’s performance standards in LDC section 6.17.
Attorney Barry and the property representative said they had met with the senior planner and that the team had addressed many planning items, were arranging a boundary survey, and were preparing a legible resubmittal. City building official Luke Curtis said building review cannot proceed without clear plans that show bathroom locations, ADA scope and the overall scope of work so reviewers can evaluate electrical, plumbing and circulation.
Augello found the respondent is making a good‑faith effort to obtain permits and continued oversight is appropriate. The magistrate did not assess fines at the hearing but scheduled another status hearing for Aug. 11, 2025, and warned that repeated denials could bring the matter to a final determination.
