La Conner amends fireworks code to define 'safe and sane' and limit use dates

The La Conner Town Council approved an ordinance amending Chapter 7.25 of the municipal code to clarify which fireworks are allowable, adopt the state definition of “safe and sane” devices, set local usage dates and revise penalty language.
Scott presented the draft ordinance, explaining that the changes would not take effect before July 4, 2026, because state law requires a year’s notice for some local changes. The ordinance narrows allowable use dates compared with the broader state window, adopts state definitions for safe-and-sane devices (sparklers, snakes and similar items) and reorganizes the penalty provisions to distinguish between infractions and misdemeanors.
Councilmembers questioned one provision that would make possession of explosive fireworks a misdemeanor and raised concerns about residents who buy fireworks outside town (for example on a reservation) and bring them home. Scott said state law already criminalizes possession in certain circumstances; council members discussed enforcement and the effect on people who purchase fireworks out of town.
After discussion the council moved, seconded and approved the ordinance. Scott noted the ordinance’s effective date will be set to apply for the 2026 season.
Councilmembers said the change clarifies local rules and gives staff a tool to coordinate with the fire chief and county burn bans when fire risk is elevated.
