The Fall River Planning Board on June 11, 2020, endorsed four Form A plans to create new building lots and accepted the withdrawal of a fifth plan after board members and staff identified frontage and wetland-permitting issues.
The endorsements, all formal votes by the three members present, affect properties on Meridian Street, Mariano Bishop Boulevard, Airport Road, Slade/Bay/Porter streets, and William Street. City Engineer Dan Aguirre summarized the technical details for each plan and recommended endorsement where the plans met Form A requirements or reflected previously granted zoning relief.
Why it matters: Form A endorsement clears subdivision-control review at the planning-board level and allows property owners to record new lot lines; subsequent construction on several parcels will require separate permitting, including conservation commission review where wetlands or buffer zones apply.
The board first considered file 25-1626, an application from R and D Realty Trust for 1493 Meridian Street. Dan Aguirre said the site is “an existing large parcel, very, very large parcel over 2 acres of land, with approximately 200 feet of frontage along Meridian Street,” and that the applicant had received a frontage waiver from the Zoning Board of Appeals to create two back lots. The board voted yes to endorse the plan.
File 25-1627 (J and H Holding Group LLC) divides a southerly-end parcel on Mariano Bishop Boulevard near the Tiverton line into four single-family lots conforming to R-8 zoning, each with more than the required 80 feet of frontage; the board endorsed the plan after brief staff explanation.
File 25-1628 (DDL Realty LLP / Madison FR Properties LLC) involved a small conveyance—a triangular parcel between two lots—to allow one neighbor to expand parking. Dan Aguirre explained the conveyance and said no variance was required; the board endorsed the plan.
File 25-1629 (Porter Street Realty Inc / Lurgan Realty Inc) would have subdivided a large 219,000-square-foot parcel along Bay, Potter and Slade streets, but the resulting Parcel 2B would have had only 91 feet of frontage where 100 feet is required. The plan as submitted relied on a proposed purchase of 9 feet from an abutting owner to conform. The applicant withdrew the plan as submitted; the board voted to accept the withdrawal.
Board members also asked staff about conservation and wetlands. On the Slade/Bay Street parcel, Aguirre noted that the bordering vegetated wetland has been flagged and that conservation commission permitting will be required for any work within a 100-foot buffer from the wetland edge. He said: “Any work in that buffer zone will require permitting.”
The final endorsement was for file 25-1630 (Around the Clock Services Inc.), which subdivides an existing parcel containing three residential structures that predate the Subdivision Control Law into three lots. Aguirre said the plan reflected zoning relief previously granted by the Zoning Board of Appeals and included required easements and set property corners; the board voted to endorse the plan.
Procedural notes: the board tabled approval of the May 14, 2025, meeting minutes to its next meeting in July because a quorum of members who attended that meeting was not present. There were no public comments. The board adjourned after completing the agenda.
