Commission approves conditional-use permit for Davis Mountain Estate with access condition

Morgan County commissioners on June 3 approved a conditional-use permit (CUP) for Davis Mountain Estate, a private recreational resort located within agricultural zoning. Staff recommended approval with mitigating conditions; the commission accepted the staff recommendation with one wording change to condition 1 to strike the word “new” and require the applicant to obtain updated access approval from the Utah Department of Transportation (UDOT) for existing access rather than seeking a brand-new access point.

Planning staff said the request required a CUP under the current agricultural zoning (A-20) following a rezone earlier this year that split portions of the property into different zones. Staff had reviewed site impacts and suggested conditions addressing traffic, access and other mitigations. The developer has been in discussions with UDOT about access for several months and will submit a traffic study as part of the UDOT application.

Because the county’s planning commission had not been able to act on the item (its meeting lacked a quorum), staff presented a positive recommendation to the county commission. The commission approved the CUP with the revised condition and asked staff to track UDOT access approval as a follow-up item; no planning-commission recommendation was available because the planning meeting had been canceled for lack of quorum.
