County authorizes lawsuit over state rule on prosecutors’ reporting requirements

El Paso County's Commissioners Court on May 5 authorized the county attorney and district attorney’s offices to pursue litigation against the Texas Attorney General over the implementation of reporting requirements found in the Texas Administrative Code, Title 1, Chapter 56.
County Attorney Christina Sanchez told the court the offices were seeking authorization to file suit over the Attorney General’s implementation of the rule. On the record she said: “We're requesting that the court approve and authorize El Paso County, the El Paso County Attorney's Office, District Attorney's Office to file a lawsuit against the Texas Attorney General and the Office of the Attorney General regarding implementation of Texas Administrative Code chapter 56 title 1 related to DAs and CAs reporting requirements.”
Judge Ricardo Samaniego moved to authorize the action and Commissioner Coronado seconded the motion. The court approved the request. The county attorney did not provide further litigation strategy in open session; the matter was handled under the legal authority the county attorney identified and the court authorized litigation.
The court did not discuss specific remedies or a timetable for filing during the public session; the county attorney's office will pursue next steps consistent with the court’s authorization and will provide updates as appropriate.
