Baker County magistrate dismisses code case after Allgires bring property into compliance

Special Magistrate Geraldine Hart dismissed a Baker County code-enforcement case against Robert and Linda Allgire after county staff found the couple's property in compliance.

Hart told the Allgires the county's photographs and staff reports showed the issues had been resolved and that the property no longer violated the cited codes. "I'm going to dismiss your dismiss the case on staff's recommendation, that you've come into compliance and you are free to go," Hart said.

The Allgires had asked about a large pile of vegetation and about parking an additional vehicle on the property while they worked on it. Hart said the pile appeared to be natural vegetation "almost because of all the growth" and advised the couple to keep landscaping trimmed and neat to comply with the county code. She said she could not give legal advice or pre-judge future complaints.

On the question of vehicles, Hart explained county rules require untagged or unregistered vehicles to be kept within an enclosed structure; she said the transcript did not specifically prohibit fitted car covers and that locating work vehicles behind the house and using a fitted cover would be preferable to leaving them in front yards. Robert Allgire said the vehicle in question was the family's only truck and would be quickly repaired and registered.

Hart thanked the Allgires for their work to bring the property into compliance and noted staff's recommendation supported dismissal of the case.

The magistrate closed the case and allowed the Allgires to leave without further action.
