Henderson County Commissioners on April 8 approved a discretionary exemption under Appendix U to allow a division of land in Precinct 2, permitting the owner to convey a 5.96-acre parcel.
The request was filed by property owner Ms. Reynolds for parcel ID 311436. Gordon Strom, a county official, described the request as a straightforward division of a larger tract that appeared to include prior divisions more than 20 years ago. Ms. Reynolds testified she is the owner, is not a real-estate developer, checked the self-conducted floodplain/drainage assessment and said there is no floodplain in the area; she also confirmed she had not made other divisions of land in the past five years.
Motion and vote: Motion made by Commissioner Tooley and seconded by Commissioner Spivey. The motion passed unanimously.
Clarifying details recorded in the meeting: the parcel owner requested to cut out 5.96 acres to sell to a third party; prior divisions of the larger tract appear to have been more than 20 years ago and included a conveyance to a water supply corporation. The court authorized the judge’s signature on the approval.
What this does and does not do: The approval grants a discretionary exemption to the county planning rules for this specific division; it is not a broad change to subdivision regulations and does not in itself authorize development beyond normal county permitting requirements.
