The Germantown Plan Commission handled a slate of development items at its April 14 meeting, approving code changes, several rezoning and land-division requests, a building addition, and an extension to a prior site-plan/conditional-use approval.
Key approvals and votes (votes listed as recorded in the meeting minutes and staff reports):
Votes at a glance
- Text amendments to Village Code Sections 14 (Building) and 17 (Zoning) to add temporary commercial outdoor accessory-structure provisions and to codify trash/recycling enclosure design standards — approved by the commission after public hearing. (Action: code amendment; mover/second: motion made and seconded; outcome: approved.)
- Rezoning and Certified Survey Map: Trio Engineering, agent for Charles Smith (W148 N12470 Pleasant View Drive). Rezoning portion of property from A-1 to RS-1 (single-family) and A-2 for remaining acres, plus 2-lot CSM — approved (staff recommended; no public opposition recorded). (Action: land_use; outcome: approved.)
- Rezoning and CSM: Shepherd / Laskowski property line adjustment (Willow Creek Road / Birch Lane) to correct encroachments and align zoning to existing uses; CSMs and matching rezoning (A-2 ↔ RS-1) approved subject to technical conditions. Staff noted an unpermitted building that crossed a property line; staff will follow up on the permitting issue separate from the land-exchange approvals. (Action: land_use; outcome: approved.)
- Rezoning and CSM: Hilltop Drive property-line adjustments among three parcels (Saramuga / Wenger / Hyde) to tidy lot lines and compliance with district standards — approved. (Action: land_use; outcome: approved.)
- Site plan: Design to Construct agent for WAGO Corporation (North 120 W19129 Freistadt Road) — 18,626-square-foot building addition to existing industrial/warehouse facility in Germantown Industrial Park; landscaping, dumpster relocation and other conditions approved subject to eight conditions in staff report. (Action: land_use / site_plan; outcome: approved.)
- Site-plan/CUP extension: Crew Car Wash (N96 W17500 County Line Road) — applicant requested an extension of both site plan and conditional-use approvals for 12 months because demolition, underground-tank removal and coordinated multi-site construction timing were not expected to start within the original 12-month window; commission approved extension of the site plan and recommended the Village Board approve the CUP extension. (Action: other; outcome: site-plan extension approved by commission; CUP extension forwarded to Village Board.)
Public comment and hearings The commission held public hearings where required. On the building-code amendments, business and residential speakers asked whether agricultural structures and small seasonal farm-stand shelters would be affected; staff said agricultural and farm-stand provisions remain governed by other zoning sections and that temporary commercial structures such as restaurant gazebos and tents would be subject to a building permit and review by the building inspector and fire chief.
On several CSMs, staff confirmed village surveyor comments were addressed before final approval. For the Shepherd/Laskowski exchange, staff advised the commission it will follow up on unpermitted construction that crossed a property line; the land-exchange itself was approved to resolve the encroachment.
What the approvals mean Most approvals were conditional on staff and village-surveyor technical items being resolved, and several will require subsequent village-board or administrative signoffs (for example, the Crew Car Wash CUP extension requires Village Board action). The WAGO expansion moves forward with the understanding that detention capacity, hydrant coordination and final landscape acceptance will be completed per staff conditions.
Ending The commission closed the night after welcoming residents and reminding the public that several of these matters will be considered again at the Village Board; residents wishing to comment can do so during Village Board public input.
