Marshall County’s Board of Zoning Appeals voted on multiple property-split and development-standard variance requests on Feb. 11, approving several administrative splits and asking applicants to provide follow-up site plans where needed.
Notable decisions - Miller (case 25BZA05): The board approved a split to allow a farm family member to lease and operate part of an existing parcel; planning staff recommended a two-parcel split shaped to meet the ordinance’s size/shape standards.
- Irene Corp (case 25BZA06 and 25BZA07): Two separate split requests seeking relief from the county’s 1-to-3 width-to-depth ratio for agricultural parcels were approved after staff review and technical review committee recommendation. One request included a woodland boundary that the buyer intends to preserve and required a review for wetlands; the board approved the split and asked staff to note wetland constraints.
- Poisal (case 25BZA04): A proposed conversion of an existing garage into a second residence on a nine‑acre A-1 parcel generated discussion about alternate approaches (lot replatting or moving a house). The board voted to table the item to allow the applicant time to consult with a builder and staff about replatting or other ways to meet ordinance standards.
Planning staff and the TRC advised the board on optimal split geometry and on conditions needed when splits create nonconforming parcel shapes. When wetlands, drainage or utility capacity were identified as issues staff recommended further technical review before final building permits. The board recorded roll-call votes for the approvals; staff will prepare written decisions and any required site-plan or drainage follow-up.
