Sunrise development settlement talks: county and school board agree to postpone to finalize contract terms

Two agenda items related to the Sunrise development—(F1) a county settlement agreement with the school board and (F2) a settlement agreement among the school board, Mac Family Partnership LTD and Hawk Sunrise LLC—were postponed Oct. 7 while the developer and property owners finalize contract language and confirm the parties' signatures.

The school district’s counsel told the board it had approved the documents and preferred not to delay, stating the district wanted to resolve the dispute over school concurrency without further postponement. Developer representatives and owners’ counsel said late edits and missing owner signatures required additional time to ensure any amendment to the original development agreement would correctly reflect all ownership entities and the parties’ intent.

Owners’ counsel told the board that because the proposed action would amend an existing contract, all parties to the original development agreement must agree to the amendment; owners have requested edits and showed substantive comments sent to the school board and developer. The board voted 4‑0 to postpone both items to a future hearing date yet to be determined so the parties could finalize redlines and signatures.

Staff said the settlement contemplates either construction of a school site within the Sunrise project or payment of impact fees as provided by the agreement language to resolve the concurrency dispute, but the precise approach will be clarified as the documents are finalized.
