City outlines implementation steps for vacant-structure ordinance; November 1 effective date set

City attorneys and staff presented an implementation timeline and administrative forms for the recently adopted vacant-structure ordinance and said the code’s enforcement phase will begin Nov. 1.

City attorney Joe Baldwin (identified in the meeting) told commissioners the ordinance aims to address blight, fire risk, trespassing and related public-safety and property-value concerns by creating a working registry of vacant structures, requiring annual inspections and requiring out-of-town owners to designate local agents with 24-hour contact information.

Baldwin previewed forms that will be distributed to known vacant-structure owners, including a notice to be posted on affected buildings and a letter of agency authorizing police to trespass individuals at vacant properties without contacting the owner for each incident. He said the trespass form will initially be targeted to downtown Main Street properties covered by the phased-in rollout but will later be available to all property owners citywide.

Baldwin said the city’s approach is educational through September and October and that enforcement will ramp up beginning Nov. 1; he also said state law preempts a specific monetary penalty for failing to register voluntarily, but once a property is subject to the city’s heightened inspection standards it may be subject to existing code-enforcement fines for violations discovered through inspection.

Why it matters: The ordinance changes how the city monitors and responds to vacant buildings, provides a streamlined trespass mechanism for the police department and may accelerate code enforcement for structures that do not meet minimum standards.
