County staff and legal counsel explained that the statutory mediation procedure applies primarily to disputes between developers and neighboring property owners where the board mediates a discrete disagreement. The panel concluded the developer's dispute with development services over whether the project meets the development agreement conditions is not the type of matter the statute contemplates. Commissioners and staff advised the developer to pursue an application to amend the development agreement or supply additional data to development services for reconsideration.
Speakers emphasized the centrality of water issues in development decisions and noted that developers may reapply or provide additional hydrologic information if they seek a different outcome. The board then moved to deny the mediation request; the motion passed on a unanimous voice vote.
