Eagan council approves amendment to stormwater code tightening post‑construction infiltration rules

The Eagan City Council on July 15 approved an amendment to City Code section 4.34 that updates the city's stormwater management regulations to add infiltration requirements for post‑construction stormwater treatment systems.
City Attorney Ms. Miller told the council that "city code section 4.34 establishes regulations that control and manage stormwater runoff" and that staff had identified revisions needed to address changes requested by pollution control agency staff and "to meet the requirements of the MS4 permit process." Deputy Public Works Director Plath was present to answer technical questions, Ms. Miller said.
The ordinance amendment was first authorized for drafting at the July 1 meeting; on July 15 Council member Fields moved to approve the amendment addressing infiltration requirements and the council voted to approve the motion. The meeting record shows the motion was seconded and the mayor called for the aye/nay vote; the motion carried.
Councilors had no additional public comment on the ordinance at the July 15 session. The council did not hold a formal public hearing on the amendment during this meeting; Ms. Miller framed the change as necessary to align city code with the MS4 (Municipal Separate Storm Sewer System) permit process and the pollution control agency's requests.
Separately, the council adopted the consent agenda. Councilor Buckland called attention to item N on the consent docket, a change order for the Eagan Art House, noting it represented a decrease in the contract amount. Councilor Buckland said, "it's not often that we have a construction change order that actually represents a decrease in the contract amount." The consent agenda motion to adopt the balance of consent items was moved by Council member Hansen and adopted.
The meeting included no public hearings and no new business beyond the ordinance amendment. The council closed the public portion of the meeting and moved to a closed session announced by Ms. Miller for a workers' compensation legal discussion with the city attorney; cameras were turned off and members of the public were asked to leave the room prior to the closed session.
