Morrison County approves rezoning for auto-repair site; interim use permit required

The Morrison County Board of Commissioners voted unanimously to rezone a parcel owned by Jason Pauley from rural residential to agricultural zoning, clearing the way for the applicant to pursue an interim use permit to continue an existing auto-repair business.

Amy Kowalsic, land services director, said the planning commission recommended approval. Commissioners discussed neighborhood character, the risk of “spot zoning,” and enforcement limits for purely private activity on the parcel. Kowalsic said automotive repair is allowed in the agricultural district only with an interim use permit (IUP), and that the IUP process is the appropriate venue to set conditions addressing vehicle storage limits, inoperable vehicles, handling and storage of fluids and tires, and a finite end date if required.

Commissioner Winter noted nearby land uses include agricultural fields and said several neighbors spoke in support; the township provided input but did not give a formal recommendation. Commissioner Casper said the board must take care to balance rural residential character with an owner’s livelihood. The board agreed a supermajority was required for rezoning; the motion passed 5-0.

Next steps: If the rezone stands, Pauley must apply for an interim use permit, where the county can impose terms (vehicle limits, storage and waste handling, and an end date) to address nuisance or environmental concerns. If the rezone were denied, the county said the repair business would not be allowed under rural residential zoning and could face enforcement.
