Marion County staff propose adding specific 'government use' permitted uses to land-development code

Marion County staff on June 4 presented proposed edits to the county's Land Development Code that would add a list of permitted and special uses for properties classified as "government use." The commission did not take final action; staff said the item will return for a public hearing in July.

The revisions, explained by Kathleen Rignoli of Growth Services, would add as permitted government uses: fire stations; libraries; parks and recreation areas up to 10 acres; post offices; sheriff's substations; government-owned assembly/auditorium/conference centers of up to 250 seats; and government administrative offices. Larger assembly spaces (greater than 250 seats) and parks larger than 10 acres would be listed as special uses, Rignoli said. Development standards for the government-use classification were drafted to mimic the county's B-2 zoning requirements, she said.

Why this matters: the change would move several functions into an explicit county land-use category to make review clearer for government projects and for neighboring property owners.

Rignoli said the permitted uses were chosen because they were "generally not impactful to surrounding properties," and staff added development standards to address compatibility. Commissioners asked for clarified definitions; one commissioner asked specifically for the definition of "market value," which staff said appears later in the packet and is subject to a separate adjustment.

Commissioners also discussed how schools were handled. Rignoli said schools had been considered for permitted status in earlier drafts, "but after speaking with the land development meetings, there were some concerns with that just being a permitted use by right. They were wanting to leave that as special" because of stadiums, lighting and noise. The change keeps schools as a special use rather than allowing them by right.

Other edits noted by staff: the sheriff's substation was moved into permitted uses; fire stations were shifted from special to permitted uses. Staff said definitions and development standards would be included in the revised code language and that the item will be scheduled for a future public hearing.

Staff and commissioners encouraged public comment at the session; no members of the public spoke on the item at this meeting.

The proposal will return for a public hearing in July so the commission can consider public comment and any further direction from commissioners.
