Committee reviews resolution to terminate cross-exit easement in Applecross subdivision

The New Castle County Land Use Committee considered a resolution to terminate a cross-exit easement affecting Lots 23 and 24 in the Applecross Subdivision at its meeting.

An attorney representing both property owners, Thomas Mamarella, told the committee the two lots have separate driveways and that the parties agreed the easement is no longer necessary. “Both property owners have agreed to the termination,” Mamarella said, adding that a sale of Lot 24 included a release of easement rights by the buyers and sellers that left the properties independent.

Councilwoman Durham said the Land Use Department had reviewed the request and concurred. “It has been through the land use department and, gotten their concurrence,” she said. Committee members reported no public objections at the time of the meeting.

The item was not finally decided; the chair said it would be placed on the full County Council agenda for formal approval next Tuesday. No formal vote on the termination occurred at the committee meeting.
