Planning commission forwards Atlantic Boulevard proffer amendment after VHDA policy change

The Loudoun County Planning Commission on March 14 voted to forward the Atlantic Boulevard proffer amendment to the Board of Supervisors with a recommendation of approval.
Staff presented the amendment as a limited change to proffers for a roughly 3-acre property east of Route 28 in the Sterling election district that was rezoned in June 2024 to an R-24 ADU legacy zoning district. Allison Britton of the Department of Planning and Zoning told commissioners that "staff find the proposed amendment to remain consistent with the 2019 general plan, and recommend the planning commission forward the application to the board with a recommendation of approval." Staff said the amendment's purpose is to align the approved proffer language with Virginia Housing Development Authority (VHDA) funding rules.
An applicant representative explained the operational reason behind the request: "Virginia Housing changed their policy from the time we wrote the proffers until now ... they changed the policy, so we're ... in the process of getting our site plan approved. They changed the policy, so we're, and it's actually, don't wanna belabor it, but it's to the benefit of the county actually." The representative said the previous proffer would have preserved five affordable units at 50 percent of AMI in foreclosure scenarios, while the VHDA change allows "up to 20% of the affordable units to survive foreclosure at 60% of AMI." Staff and the applicant said that change increases the number of units that could remain affordable under foreclosure from five to as many as 16 units under the new VHDA allowance.
Chair opened the motion to forward the item, which was seconded and approved by voice vote. The commission recorded the motion as carrying 7-0-2 with Commissioners Barnes and Jasper absent.
The amendment will now go to the Board of Supervisors for final consideration, with the planning commission's recommendation and the proffer statement dated March 5, 2025.
