Trinity County planning commission votes to refund appeal fees after approval rescinded

The Trinity County Planning Commission voted June 26 to recommend refunding appeal fees after staff rescinded approval of a cannabis license tied to CCL 8 39, making the pending appeal moot.

County staff told commissioners in a memo dated June 19 that coordination issues with other agencies and lack of final confirmation from the local fire district led them to rescind the approval. The rescission prompted a motion by a commissioner to refund appeal fees for P-25-08 because the appeal had become moot; commissioners voted in favor.

Staff said the rescission was intended to allow multi-agency coordination and any necessary project changes to be handled and renoticed at a later date. The commission’s motion to refund fees did not specify an amount; commissioners and staff treated the motion as a recommendation to the Board of Supervisors that the fee be returned to the appellant.

The commission took the refund recommendation by voice vote; commissioners answered “Aye” when the chair called for the motion. The matter will proceed as a recommendation to the Board of Supervisors for any final administrative or financial action.

No additional technical questions for staff were raised at the meeting regarding the rescission.
