The East Point Planning Commission on Oct. 16 approved a variance permitting a modest deck to be attached to the rear of a house at 1917 Thompson Avenue, relieving the applicant from strict application of the city’s stream-buffer setback requirements.
Applicant Lance Muller told commissioners the proposal is for a 12-by-20-foot wooden deck attached to the rear of the existing dwelling. He described the lot as constrained by steep topography and a creek with a 50-foot vegetative buffer and a 75-foot impervious setback; he said the deck would be supported on piers, would not increase impervious area beneath it, would preserve mature vegetation, and would include additional native plantings as mitigation. Muller said the deck elevation would be roughly 39 feet above the stream and that the house and deck are not in a flood plain.
Staff recommended approval of the variance from the city’s stream-buffer setback rules, concluding the requested relief was the minimum necessary, would not reestablish or enlarge a nonconforming use, and could be mitigated with native plantings and construction measures that preserve infiltration and bank stability.
No speakers opposed the application at the public hearing. Commissioners moved to accept staff’s recommendation for approval and the motion carried as recorded in the meeting transcript.
The commission’s action authorizes the variance; the applicant must still obtain building permits and comply with conditions imposed by permitting and environmental-review processes.
