GUTHRIE, Okla. — The Guthrie City Council unanimously approved amendments to Chapter 5, Article 9 of the city code on Tuesday to conform local food‑truck rules to recent changes in Oklahoma law and the 2018 fire code.
Planning staff Dan Casey told the council state statute now precludes municipalities from imposing geographic restrictions on where food trucks may operate. “State law no longer allows any municipality to put geographical restrictions on food trucks,” Casey said, noting Guthrie’s prior code had prohibited operations within 300 feet of a restaurant or event.
The ordinance removes duplicative local licensing requirements and states the city will accept the State of Oklahoma food‑truck license. Casey also said the city would lower the local permit fee from $75 to $25 to avoid “exorbitant fees” and to match the limited verification role the city now plays when the state issues licenses.
Council members asked whether the changes would allow vendors to set up near community events such as the 80 Niners; staff said private property vendors could locate across from events and that time‑on‑site limitations imposed by some other cities are no longer permissible under state law.
The council moved and unanimously adopted ordinance 34‑29 with the revisions presented by staff.
