Committee approves opinion: 'building adjacent thereto' requires permanent toilet facilities

The BRFW committee voted Sept. 12 to approve an interpretive opinion finding that language in the International Building Coderegarding "building adjacent thereto" refers to permanent toilet facilities, not portable toilets or restroom trailers that can be removed from a site.
Staff explained that section 2902 of the IBC sets minimum plumbing facilities for a building and that removable fixtures that, when removed, would render the building noncompliant are not the intent of the provision. Committee members noted limited exceptions may exist for temporary emergency shelters or other short-term uses but that, as a general rule, permanent facilities are required.
Dan Young moved approval of the interpretation; the motion was seconded and passed by oral vote. The committee recorded the opinion as approved and will post the final text as the committeeopinion on the SBCC website.
Why it matters: The interpretation clarifies how building officials should treat portable sanitation in relation to minimum facility requirements under the IBC. For most occupancies, a building-dependent minimum must be met by permanent plumbing fixtures; temporary arrangements will require separate review.
