Directors raised legal questions about proposed affirmative-action language in policy 401.1 during the Policy & Governance Committee meeting of the Iowa City Comm School District.
Director (Speaker 7) said the change was not highlighted in the table of contents and asked whether the new language remains appropriate given recent changes and legal challenges. "Like, is this language kosher now with all of weird stuff?" the director asked.
Director (Speaker 4) responded that executive orders from the White House are currently being challenged in court and that existing federal statute remains relevant to the district's obligations. "The executive orders from the White House are still being challenged legally, but existing federal law would make that requirement the question that, of course, will resolve the letter," he said.
Staff said they are working with legal counsel to ensure the district's affirmative-action and equal-opportunity employment plans are "more appropriately aligned" and that the committee would revisit those plans in December. Staff also referenced ISB legal advice as part of the review process.
Directors indicated comfort with moving forward with the primer language if legal counsel concurs, but several asked staff to double-check the wording before final approval.
What's next: staff will continue legal review and return with recommended edits; the committee plans a more formal review of affirmative-action and equal-opportunity employment plans in December.
