County legal counsel said the document as drafted could be interpreted as a commitment to construct a year-round facility co-located with the sheriff's complex and recommended caution because the addendum contains language that could be used as evidence of an enforceable promise. Counsel said the current format is a nonbinding expression of intent but advised that signing a document that specifies a site or promises construction could be read against the county.
Ogden City had already signed documentation filed with the state for temporary shelter arrangements and sought a county signature to indicate joint intent to pursue a permanent facility. Commissioners said they support finding a permanent shelter solution but rejected committing to a specific site (Twelfth Street or the sheriff's complex) in a way that would constrain future options. Commissioners asked county counsel to draft revised language that expresses the county's commitment to seeking a permanent solution and to retain flexibility on location and funding. Staff will share proposed language with Ogden City for review.
