The Finance & Administration Committee on Oct. 16 approved a dumpster license and indemnity agreement that governs shared dumpsters behind 230 Haverford. Staff said the agreement formalizes access and usage rules for the dumpsters that serve multiple properties and will protect rights and liabilities for the borough and neighboring businesses.
Committee discussion noted two provisions worth highlighting: the borough retains the right to terminate the license when redevelopment or a property-owner-provided dumpster becomes required, and the license contains an indemnification clause obligating the licensee to hold the borough harmless for liabilities arising from the dumpster use. Staff said the provision anticipates that, once redevelopment occurs, the property owner (identified in the packet narrative as Tim Ruben) will be required to provide private dumpsters for the redeveloped property.
The motion to approve the license passed 2-0. Staff will file the executed agreement and the license terms with borough records and monitor termination conditions when redevelopment activity begins.
