Burleigh County commissioners’ Missouri Valley Complex committee agreed to hold off on plat review for the Missouri Valley Complex until a pending city–county agreement clarifies which jurisdiction will have planning and zoning authority. Commissioner Munson told the committee staff will proceed with advertising a wetland mitigation procurement related to the 401404 permit and that Swenson Hagen will help prepare the bid request.
The move matters because stormwater and infrastructure requirements differ depending on whether the complex remains under the City of Bismarck’s ETA rules or shifts to Burleigh County control, staff said. A county-controlled plat could change required stormwater management plans, road network expectations and whether city sanitary sewer and water remain in place, affecting how the plat is laid out and which agency reviews final documents.
“I’ll get it to Mark this week and we’ll get that request out,” Commissioner Munson said, urging staff to move the mitigation procurement forward even as the jurisdictional question is resolved. Presenter Jason Patresian told the committee that bidding and contracting for wetland delineation and mitigation will advance the work but warned that broader federal or Interior Department policy changes to wetland standards could delay final permitting, possibly extending some work into next year.
Committee members asked that county planning and highway staff and Swenson Hagen attend the next meeting or a separate session as soon as the city council acts so the committee can align plat layout, stormwater design and infrastructure agreements with the authority that will make final decisions. The committee will watch the city council meeting next week and reconvene planning discussions once the city’s action on the agreement is final.
