Council debates objective scoring for Planned Development District ordinance in first reading

Councilors spent extended time in first-reading discussion over proposed amendments to Chapter 15 to codify a Planned Development District (PDD) process that uses staff-scored objective criteria. The mayor and councilor who introduced the item said the goal is to replace subjective language with measurable thresholds (example categories proposed: green/open space percentage, community benefits, public improvements, no underlying-zoning variances requested).

Councilors raised multiple substantive issues: whether the staff scoring is legally defensible and appealsable; whether specific point assignments (for example, heritage-tree preservation, no-variance requests, public improvements) should be increased or decreased; and whether the proposed passing threshold of 70 points is sufficiently rigorous for a "superior" development. Council members suggested raising the passing threshold and rebalancing points (for example, giving more weight to heritage-tree preservation and no-variance requests) and asked staff to prepare a spreadsheet that shows alternate weightings for further review.

The city attorney and staff said objective, verifiable criteria are more defensible in court than subjective standards but acknowledged that litigation risk cannot be eliminated. Council agreed to accept written comments and suggested edits from members and to return the item to the Nov. 18 meeting for further refinement.
