The Planning Commission on Dec. 19 approved a conditional use authorization for a cannabis retail business with an on‑site consumption lounge at 40 Twelfth Street, a project submitted by a qualified equity applicant.
Staff planner Alex Westhoff said the property is in an NCT‑3 transit‑oriented district and that the project meets the city’s 600‑foot separation requirement from sensitive uses. Staff recommended approval, noting the proposal would activate a vacant storefront, restore historic Art Deco facade elements and provide economic opportunity in the Market‑Octavia corridor.
Applicant Kevin Bourne described outreach to nearby institutions, removal of curb cuts and addition of bicycle parking, and argued the site would help serve new housing under construction nearby. The project includes an on‑site consumption lounge in the back of the retail space; the applicant said the lounge is physically separated from the street and would use negative‑pressure HVAC and filtration.
Commission discussion focused on whether on‑site consumption would create spillover effects. Commissioner Fung said he opposed on‑site consumption, citing concerns about making spaces airtight and enforcement challenges. Other commissioners concluded the proposed location and controls were appropriate. The motion to approve the use including the on‑site consumption lounge passed 5–1, with Commissioner Fung voting against.
