Council approves amendment to Lassen Townhome development agreement to ease right-of-way acquisition

The Livermore City Council unanimously approved a second amendment to the development agreement for the Lassen Townhome project on July 28, allowing a change to how required off-site right-of-way acquisitions will be handled so the developer can proceed with construction of the townhome project.
Assistant planner Emily Ladue summarized the 2020-approved project, which includes 186 townhome units with 14 affordable units and off-site improvements such as a corrosion-resistant sewer replacement, a Class I off-street trail connecting Lassen and Redwood Roads, and Springtown Boulevard median work. The original development agreement required the developer to acquire necessary right of way; staff said the developer has been unable to negotiate with an adjacent owner and requested relief from the acquisition obligation.
"Staff has been able to negotiate preliminary terms to acquire the necessary right of way needed to facilitate the improvements directly from the adjacent property owner," Ladue said, and recommended amending the agreement so the city could complete the public improvements in a timely and cost-effective manner while the developer remains responsible for design, permitting and paying for certain elements.
The planning commission unanimously recommended approval on June 17, 2025. Councilmember Dunbar praised the long effort to secure the connection and supported moving the project forward. The motion to accept staff recommendations passed unanimously.
