Rowlett City Council unanimously adopted (item 3J) a zoning-text amendment on Sept. 9 that will require special-use permits for car washes and alter the table of allowed uses to require SUPs for certain light automotive-repair uses in specified zoning districts.
Staff explained the changes would require SUP review for car washes in districts where they had previously been allowed by right and would require an SUP for light automotive repair in the M1 district (in addition to existing SUP requirements in C1 and C2). The ordinance authorizes staff to notify any businesses that could become legally nonconforming as a result of the change; staff explained legally nonconforming uses may continue subject to limits (for example, discontinuation of use for 180 days can result in loss of nonconforming status).
The staff presentation noted the city had previously sent notices to affected businesses (explaining potential nonconforming status) and that the proposed amendment was partly intended to give the council more oversight of where car washes and light automotive repair businesses establish. Councilmembers applauded the update and emphasized the ordinance clarifies the city’s authority to manage these land uses going forward.
What happens next: Businesses identified in the notice will retain nonconforming status unless they cease operation or undertake renovations that trigger loss of that status; new car-wash uses in affected districts will require an SUP going forward.
