Commission amends code to allow polypropylene pipe in rights‑of‑way but keeps inverted siphon waivers before the board

Brevard County commissioners on Dec. 3 approved an amendment to Chapter 62 of the County Code to add high‑performance polypropylene pipe as an acceptable material for certain right‑of‑way applications and to refine approval pathways for inverted siphons.

Public Works staff explained the change would allow polypropylene pipe in commercial applications and create an administrative process to expedite approvals in appropriate cases; residential HOAs and residential right‑of‑way were excluded because of maintenance concerns. Commissioners voiced strong concern about inverted siphons, citing past nationwide maintenance problems and potential flood risk if such structures are not maintained. Staff said maintenance agreements and documentation from property owners would be required as part of any approval.

Commissioner Delaney moved to approve the amendment but to retain Board oversight for any waiver of inverted siphons so there would be a public record of decisions. The motion was seconded, debated and passed by roll call. County staff said they will redraft the final ordinance language with the county attorney and return the final resolution for signature.
