Staff described the package of requests: a special‑use approval required by the zoning code for daycare centers; a variation (PV25‑0003) to reduce required rear and side yard setbacks from 19 ft and 25 ft to 0 ft for the playground area; a second variation (PV25‑0004) to allow an existing 5‑ft perimeter fence in one section instead of the code‑required 6 ft; and PSPMIN25‑0033, a minor site plan to construct the playground and related site improvements.
Owner Katrina Shafran and broker Anna Linscheid explained operations and safety plans. Shafran said K Educate will operate three classrooms and hire staff to meet state ratios: “I—'m the owner of K Educate, and I wanna build their day care center because I have experience with home day care, and I wanna just expand my business.” Petitioners said playground surfacing will be engineered mulch 6 inches deep, and proposed planting 34 Arborvitae along the north and east property lines as a buffer. Staff noted about 10 trees will be removed and that grading and drainage work is required.
Commissioners questioned parking and traffic flow during morning/evening peaks, gate and emergency exit arrangements, staff‑to‑child ratios (age dependent, either 1:8 or 1:10), and how many children will be outside at once (petitioners said two playgrounds will allow rotation so the full licensed maximum is never outside at once; the maximum licensable number stated in the hearing was 56 children). The commission attached conditions including: contingent approvals linking the special use to the two variations and the site plan; requirement to obtain and submit a State of Illinois Department of Children and Family Services (DCFS) license before a Wheeling business license is issued; hours limited to Monday–Friday, 7 a.m.–6 p.m.; installation of 34 Arborvitae by May 1, 2026; repair of leaning fence sections; application for permits prior to grading or tree removal; re‑striping of parking to village standards by June 1, 2026; and a Wheeling sign permit for any exterior signage.
The commission voted on each docket separately and approved the special use, both variations and the minor site plan. Staff said the minor site plan approval at this level does not require further Plan Commission review and that the petitions will proceed to the village board for final actions typically handled more quickly.
