County authorizes limited start on 55 Brown Road solar project to protect federal tax credits

Tompkins County legislators on Dec. 16 authorized the county administrator to begin limited construction on a planned solar array at 55 Brown Road so the county can meet a construction-in-beginning deadline tied to federal clean-energy tax credits.
County administration told the legislature that Cornell, the ground-lease holder for the industrial-park parcel, requested additional insurance and lease provisions while negotiations continue. County Attorney Maury Josephson explained the narrowly written authorization lets the county begin limited, Cornell-consented construction aimed only at preserving eligibility for an estimated $300,000 in tax credits, while the parties finish negotiating an amendment and return the fully negotiated amendment to the legislature for approval.
Jennifer Tavares, representing Cornell community relations, told members Cornell legal and real-estate staff are actively negotiating; administration said it is preparing cost estimates for the additional insurance items Cornell requested. Several legislators pushed back on the timing and on Cornell’s late insurance requests, with one noting the county had been a long-standing tenant in the industrial park and expressing surprise at the newly proposed requirements.
Supporters argued the county should protect the tax-credit value by beginning limited activities. Opponents asked that administration obtain cost estimates and seek cost-sharing for additional insurance requirements. The measure passed, 12–2.
Administration said it will return with the negotiated ground-lease amendment and a full accounting of any new insurance cost estimates; if the legislature later rejects the amendment, members were told there may be a limited dismantling cost for work already undertaken to protect the tax credits.
