The commission approved PRE25-12, a preliminary plat to incorporate additional lots into the Nightingale subdivision, on Dec. 17, enabling the applicant to pursue final-plat technical review and fulfill documentation requirements.
Staff said the proposed subdivision will reconfigure existing lots to create a seven-lot pattern consistent with nearby rural-residential lots (median lot size slightly over three acres). Each lot will use individual wells and individual wastewater systems and Nightingale Court provides existing access. Staff confirmed no floodplain or major stormwater concerns for the lots included and recommended approval with standard technical conditions.
A resident and subdivision representative told the commission the homeowners association has prepared amended covenants, bylaws and rules and has gathered more than 51% of owner consents to amend Birdsong Meadows covenants and form the Nightingale homeowners association; one lender signature (a mortgage held out of state) remains pending. Staff explained final plat signatures and bank/lender acknowledgments would be obtained during final-plat processing.
The motion to approve the preliminary plat passed on a recorded vote. The applicant was instructed to return with the final plat and all required lender and owner signatures for recording.
Next steps: applicant to complete and submit final plat documents, secure notarized owner and lender signatures, and submit the final plat for administrative technical review and recording.
