Brighton OKs updated Bromley Farm reimbursement agreement; developer to construct and be reimbursed from impact fees

Brighton City Council approved an updated construction and reimbursement agreement for the Bromley Farm subdivision on Dec. 2, authorizing city staff to execute the agreement and rescinding the prior resolution that had approved an earlier draft.

Principal Planner Nick DeMario explained the changes to the previously approved draft. The property is roughly 139.79 acres; the subdivision approval anticipates a large single‑family and multifamily buildout and requires the developer to design and construct specified on‑site and off‑site improvements. Off‑site improvements (roadways, a traffic signal, trail connections, and drainage work on city‑owned properties) will be reimbursed using development impact fees; DeMario said those fees were estimated in the presentation at roughly $8.9 million for the improvements subject to reimbursement.

Two changes from the previously approved draft were highlighted: the city will reimburse 100% of design and construction costs for specified off‑site drainage improvements on city‑owned property, and the on‑site storm sewer pipe will be reimbursed at a maximum of 6% of design and construction costs. DeMario said reimbursement will not exceed actual costs or the total impact fees collected and that construction will be inspected by the city prior to acceptance.

Council asked how the city prevents padded bids; staff responded that construction is inspected, a warranty period is required and reimbursement is for accepted work only. Council approved the updated agreement by roll call vote 7–0 with one absence.
