Subcommittee moves to codify key IDEA protections into Virginia law, with trigger for federal changes

SB678 would codify many provisions of the federal Individuals with Disabilities Education Act (IDEA) into state law and add contingency triggers and appropriation requirements for enforcement provisions. The committee recommended reporting as amended (3–0 with two abstentions) after stakeholder negotiations and technical amendments.

Senator Pekarski presented SB678 to create a durable state statutory floor for special‑education rights by codifying much of IDEA and related Section 504 protections. Sponsor and staff explained that most provisions would go into effect immediately as codified state law while certain enforcement and funding provisions would be triggered only if federal IDEA protections were repealed or nullified and if a subsequent appropriation is included.
