The Planning Board on Jan. 26 voted 4–1 to recommend Ordinance 2026-01, a comprehensive set of land-development code updates addressing accessory structures, nonconforming uses, stair and balcony encroachments, and floodplain management consistency with state building-code amendments.
Staff said the ordinance consolidates previous ordinance work and state-driven changes requested by the Florida Department of Emergency Management, aligning local definitions and floodplain management language with state standards. Major substantive changes include modifying the base stair openness standard, clarifying limits on substantial additions to historic structures, providing alternatives for front-yard setback lines on cul-de-sacs and curved lots, and revising provisions for residential storage buildings and equipment setbacks to be consistent with Chapter 98 and the Florida Building Code.
Board members raised three core issues: inconsistent percentages for stair openness in the packet (staff acknowledged an internal inconsistency and stated the intended number is 70%), whether the additional 4-foot stair encroachment relief should apply to new-build homes as well as hurricane-damaged elevated homes, and timing definitions for rebuilding after storm damage ("obtained" vs. "applied for and kept active"). Several members asked for data on how many variances had been requested in recent years to justify code changes for new builds.
Staff agreed to fix the stair-transparency inconsistencies, to adopt "applied for and kept active" language for permit timing, and to carry forward the board's recommendation to exclude the added new-build stair encroachment relief (i.e., retain relief only for owners elevating existing hurricane-damaged structures) for the commission to consider. Member votes recorded Vice Chair Angelides as the no vote on the final recommendation.
Next steps: Staff will transmit the recommended ordinance with proposed administrative edits and the board's direction about the new-build stair encroachment question to the City Commission for final action.
