A commissioner said staff indicated there was approximately $80,000 in escrow and that the remaining tasks included installing a fence and fill.
Several commissioners expressed concern about repeated extensions and their effect on neighboring property owners. One commissioner said repeated extensions left "all that raw dirt sitting out there" and could cause material to end up in neighbors' yards. Legal counsel and staff said the city had limited remedies but noted recent changes to the subdivision ordinance mean vesting can expire with a development agreement; staff also said extensions must be approved by the city and additional enforcement options would require further legal review.
Commissioner Bates moved to extend the development agreement for H. L. Parker Legacy by one year from the date of the prior expiration; Commissioner Greener seconded. The commission voted in favor and the motion passed. Staff said the developer previously projected completion by April 15, which staff said would be within typical extension timelines; staff recommended the longer one-year extension to ensure completion.
The action authorizes a formal, one-year extension of the agreement; staff indicated follow-up will include tracking completion and any necessary compliance checks.
