Committee members unanimously approved recommending to the full board an updated business-entity report (VERB) form that adds a checkbox and definition for "management control" to better capture which licensee or firm holds managerial responsibility for advertised architectural services.
Jasmine Steinberg told the committee the form and an informational bulletin were posted to the board website and will be added to the online portal and upcoming newsletter. The bulletin and form point licensees to statutory and regulatory sections describing responsible and management control for advertising architectural services.
The committee then discussed training priorities. Staff urged board training on written-contract requirements and their statutory exemptions, aiding and abetting, responsible control and common violations. Members reviewed two recent enforcement complaints in which architects invoiced homeowners directly despite the homeowner contracting with an intermediary designer or engineer; staff said the cases raise complicated questions about the definition of "client," contract exemptions when the intermediary is an engineer, and when civil contract remedies versus board discipline apply.
Vice Chair Leonard Manoukian moved to approve the staff report and strategic-plan objective for the VERB update and Steven Winkle seconded; the committee approved the recommendation by unanimous roll-call vote and asked staff to develop training for the full board on written-contract issues.
