Speaker 5, who presented the item, told the board the changes correct a missing clause that replaces the PDPA union designation with the FOP in the contracts’ representation language, clarifies Article 5 so employees who exhaust paid leave while off duty will not continue accumulating seniority, and restores Article 23.4 language on emergency response team training compensation so members receive time-and-a-half or compensatory time rather than cash. He said the omissions were unintentional and that county counsel and the FOP had confirmed the intended wording.
The change to Article 5 was explained with a staffing example: an employee who recently joined the agency could be off on an extended unpaid leave (for example after FMLA) and thereby, under the prior wording, retain seniority for shift bidding despite not having worked; the amendment prevents that outcome, the presenter said. Speaker 1 raised concern about singling out pregnancy, saying "pregnancy is not an accident. It is a life experience." Speaker 5 said the clause is intended to address any extended unpaid absence that could lock in a shift advantage and noted the union had agreed to the language.
The board called the question; the motion to approve the contract corrections was recorded as approved by 'Mister Wheeler' with a second by 'Mister Newton' and passed by unanimous voice vote as recorded in the transcript.
The approved corrections will be incorporated into all three affected contracts and returned to county personnel and union records, per staff remarks at the meeting. No amendments or separate funding actions were recorded.
