ADR seeks 10‑foot buffer for pool equipment and aligns minor‑exception rules

Planning staff introduced a draft pool and landscape setback exception that would create a 10‑foot buffer inside required yards and define landscape features including pools, spas, decks, patios and associated equipment. Staff noted the town already has a ministerial “minor exception” process that can allow air conditioners, generators and pool equipment in setbacks subject to findings and a neighbor consent requirement.

ADR members said the draft should be aligned with the existing minor‑exception route so that routine equipment does not automatically qualify to occupy the 10‑foot buffer without staff‑level review and neighbor consent. Members emphasized noise concerns for equipment placed near property lines and suggested the committee keep AC units, generators and pool equipment out of the new 10‑foot buffer unless a documented hardship or a minor‑exception finding applies.

Roberta said staff would update the draft to clarify applicability, preserve the minor‑exception pathway for equipment when appropriate, and return the revised language to ADR for confirmation before forwarding to the council.
