The Warren County Planning Commission recommended that the Board of Supervisors approve a zoning text amendment to modify front-yard setback requirements in R1 and R2 zoning districts.
Staff described a draft that would set a 50-foot front-yard setback for properties fronting state-maintained roads and a 35-foot setback for non-state roads, while aligning corner-lot and accessory-structure rules to district-specific setbacks. The proposal was presented as a response to known constraints on some riverfront and steeply sloped lots, and staff noted the Board of Supervisors had directed evaluation of a reduction in the R1 district.
Kathleen Mancini (Shenandoah District) warned that reducing setbacks could encourage building larger houses on smaller lots and strain infrastructure — wells, roads and septic systems — and urged caution. Commissioners and staff discussed how state road designation and subdivision dedications to VDOT affect which setback applies and noted that in subdivisions where roads later become state-maintained a structure built at 35 feet could become legal nonconforming. After discussing slope, septic separation requirements, and subdivision proffering, a commissioner moved and the commission voted to forward Z-2025-1201 to the Board of Supervisors with a recommendation of approval.
